LAP TIME COMPETITION - TERMS & CONDITIONS

These terms relate to the Lap Time competition ("Competition").  The promoter is Hyperlast Limited ("Company") whose address appears below. 
Entry to the Competition
1. By entering the competition, you agree that you have read, understood and accepted these general terms and conditions.

2. You must be 18 years or older to enter this competition. 

3. All entrants must provide their name, address and telephone number or email details. 

4. This competition is not open to employees and their families of the Company or any companies affiliated to The Dow Chemical Company, their agents, third party suppliers or anyone professionally connected with the administration of this competition.

5. Entries are limited to 1 entry per day for each participant.

6. The Competition is live from 6 to 8 May 2008 during the opening hours of the Vehicle Dynamics Expo 2008 in Stuttgart, Germany ("Competition Period").  No entries will be accepted after the Competition Period.

7. Entry to the Competition is free of charge.  NO PURCHASE IS NECESSARY. 

8. You can enter the Competition by obtaining an entry ticket from an authorised representative of the Company at Stand No. 3228 at the Vehicle Dynamics Expo 2008 in Stuttgart, Germany.

9. Entry to the Competition has no cash value and cannot be exchanged for cash.  The sale of, or exchange of entry tickets by unauthorised persons, are strictly forbidden.

10. The Company reserves the right to vary the way in which competition operates.

11. Any entry will be void if it is deemed incomplete, is illegible or has been made by an ineligible person.

Winner

12. There will be one winner during the Competition Period who will win two tickets to a Formula 1 Season event 2008 Grand Prix of his or her choice.  In the event of a tie where two or more entrants achieve the same recorded time, the winner will be the person who achieved the winning time first during the Competition Period.  The prize is subject to tickets being available to a maximum value of £400.00 (Four hundred Pounds Sterling).  The prize is strictly subject to availability and cannot be guaranteed.  If tickets for the winner’s first choice event are unavailable, he or she will be offered one further choice of Formula 1 event, again strictly subject to availability.   No cash or other alternative will be offered. 

13. No accommodation, travel, meals or other expenditure form part of the prize.  For the avoidance of doubt, the prize does not include any form of corporate hospitality and representatives of the Company will not attend the Formula 1 event with the winner. 

14. The name and country of the winner will appear on the the Company’s website for a period of 30 days, unless the winner notifies Hyperlast Limited. in writing that they do not wish this information to be published. 

15. The winner of the competition will be the person with the fastest lap time score during the Competition Period.  An authorised representative of the Company will act as referee and will time each competition entrant's lap time and record this information in a secure form.  The decision of the Company concerning lap times and the allocation of the prize shall be final and binding.

16. All entrants must ensure that they and the person accompanying them are legally able to accept the prize and attend the Formula 1 event of their choice. This will include that they hold a valid passport or visa if required.

17. The winner will be notified within 30 days of the end of the Competition Period by telephone or email and then confirmed by post. If contact cannot be made with an individual winner within 48 hours, the Company will continue to attempt to contact the winner for a further 28 days.  If no response is received within this time, the prize will be forfeited. 

18. Please allow a minimum of 28 days for delivery of the prize (or such other period of time as the Company may indicate). The Company may vary conditions relating to the delivery time and availability of the prize at its discretion.

19. In the event of circumstances outside of its control, the Company reserves the right to substitute similar items of equal or greater value for the prize.

Limitation of Liability

20. All entrants do so strictly at their own risk.  Entrants/the winner are responsible for ensuring that they (and any person accompanying them) are legally able to attend the Formula 1 Grand Prix event chosen and for ensuring their safety and welfare at all times in entering the Competition or accepting the prize. 

21. The Company cannot be held responsible for any damage, losses or injury caused or occurring during attendance at the F1 event.

22. The Company will not be responsible if entrants do not receive the item they have won if they have supplied insufficient, incorrect or false information when registering.

23. The Company cannot accept responsibility for any technical or other problems that mean participation is impossible or delayed, or entries are not accepted for any reason whatsoever.

24. To the extent permissible by law the Company excludes all implied warranties, conditions and other implied terms. Statutory rights will not be affected.

25. If, for any reason, the competition is not capable of running as planned during all or any part of the Competition Period, the Company reserves the right to cancel, terminate, modify or suspend all or part of it.

26. Any attempt to undermine the legitimate operation of the competition may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Company reserves the right to seek damages or other remedies to the fullest extent permitted by law. Any person suspected of cheating in the opinion of the Company, will be removed from the Competition.

General

27. The prize winner may be requested to take part in publicity but shall be under no obligation to do so. 

28. All materials submitted become the property of the Company and none will be returned.

29. All personal data will be held in accordance with applicable laws. By agreeing to these terms and conditions, you are consenting to the transfer, processing and storing of the personal data by the Company and by any companies within group of companies owned by The Dow Chemical Company within Europe and the US.  You are entitled to information as well as to correction, blocking and erasure of your stored data under certain conditions.

30. The Company will retain and use participant details for the purpose of the competition.  The Company may use details of the Competition for future marketing purposes.

31. The decision of the Company in relation to each part of this Competition will be final and binding. 

32. If any part of these general terms and conditions are found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from the remainder of these general terms and conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.

33. These general terms and conditions shall be governed by and construed in accordance with the law of England and Wales and subject to the exclusive jurisdiction of the English courts.
